RoHS enforcement is the responsibility of the 27 EU countries, and not of the European Commission or any other EU institution. The Commission does not have any legislative madate to get involved in RoHS enforcement, except inasmuch as it may feel that an EU country has not correctly implemented EU law. It is therefore important to focus on national enforcement authorities when questions arise, since RoHS enforcement will inevitably vary country-to-country.

EU Member States recognize that the complexity of potentially working with 27 different enforcement regimes is undesirable for EEE producers. Some of the Member State governments and enforcement authorities have therefore developed the guidance described below.

It does not bind the Member States in any way, and should be read with a view to understanding the broad outlines of a probable approach to enforcement in the countries that choose to follow it. Some Member States may wish not to follow this approach. Nevertheless, we feel it can provide valuable insights to business.

Don't forget! The EU's WEEE and RoHS Directives are implemented in EU countries by national WEEE and RoHS regulations. These vary considerably from country to country.
