1. Criminal Penalties for violations of the Arms Export Control Act (AECA)

  • Fines: Individuals/corporations who commit „willful violations“ of the AECA or make „an untrue statement of a material fact or an omission of a material fact on a registration or license application“ may be fined up to $1 million per violation (22 USC 2778)
  • Imprisonment: Individuals who commit „willful violations“ of the AECA or make „an untrue statement of a material fact or an omission of a material fact on a registration or license application“ may be subject to imprisonment for up to 10 years per violation (22 USC 2778)
  • Seizure and forfeiture: Exports of defense articles (or attempts at exports) made in violation of the AECA may be seized and forfeited (22 USC 401)

2. Criminal and Administrative Penalties for violations of the Export Administration Regulations (EAR)

  • Corporations: A fine of up to the greater of $1 million or five times the value of the exports for each violation.
  • Individuals: A fine of up to the greater of $250,000 or imprisonment for up to 10 years, or both, for each violation
  • For each violation of the EAR, any or all of the following administrative penalties may be imposed: the denial of export privileges; exclusion from practice; imposition of a fine for each violation
